State Charge sheet against Aisha Huang has no Weight –Hon Dafeamekpor
Hon Rockson-Nelson Kwami Dafeamekpor, Parliament for South Dayi, has expressed disappointment over the kind of charges against Aisha Huang, describing it as a completely botched prosecution.
The MP who is also a lawyer and member of the Constitutional and Legal Affairs Committee of Parliament questioned why the police are leading the prosecution instead of the Attorney General and that the facts sheet does not support the case.
Speaking on 3FM Sunrise Morning Show, the MP said the charge of galamsey against Aisha Huang will not hold because she was not arrested at the galamsey site but rather at her home. Also, she was not arrested at the scene of selling minerals. It does not establish the time of her arrival, the flight details, type of minerals, and quantum involved are all missing.
“Where did the said galamsey Aisha Huang engaged in take place? It is missing from the charge sheet. The appropriate charges have been abandoned for an arm-chair collection of facts. If you intentionally proceed on the matter in this way, then you are bound to fail in court” Dafeamekpor affirmed
The fact sheet on the latest trial of Chinese galamsey kingpin Aisha Huang and three other Chinese nationals suggests that she deliberately averted prosecution by sneaking out of the country five years ago.
An Accra Circuit Court has remanded into police custody notorious Chinese businesswoman Aisha Huang and three others standing trial for unlawfully engaging in small-scale mining without license.
The four accused appeared before the Court on Wednesday, September 14, and pleaded not guilty to the two charges of mining without a license and engaging in the sale and purchase of minerals without a valid license.
However, the South Dayi legislator espoused that for Aisha Huang to be accused of sneaking out in the middle of her previous trial in 2017 makes her a fugitive of justice which is a severe offense, therefore considering the magnitude of the crime of gold smuggling, it is appropriate to deal with it at the High Court and must be handled by the Attorney General office which could do better than the police who are not lawyers.
He however noted that at various points of the trial, amendments could be made to the charges but that could be considered persecution.
