{"id":11488,"date":"2023-06-01T04:14:37","date_gmt":"2023-06-01T04:14:37","guid":{"rendered":"https:\/\/expressnewsghana.com\/2023\/06\/01\/i-hope-the-supreme-court-decision-will-guide-current-and-future-govt-domelevo\/"},"modified":"2023-06-01T04:14:37","modified_gmt":"2023-06-01T04:14:37","slug":"i-hope-the-supreme-court-decision-will-guide-current-and-future-govt-domelevo","status":"publish","type":"post","link":"https:\/\/expressnewsghana.com\/?p=11488","title":{"rendered":"I Hope the Supreme Court Decision Will Guide Current and Future Govt- Domelevo"},"content":{"rendered":"\n<p><strong>Mr Daniel Domelevo, the embatttled for former Auditor-General Daniel Domelevo has said that the Supreme Court ruling that declared his removal from office as unconstitutional should measure the current government and future ones in their conduct.<\/strong><\/p>\n\n\n\n<p>Commenting on the ruling by the Supreme Court that declared his removal as unconstitutional, Mr Domelevo told TV3 in an interview that \u201cTo be honest with you that is very unfortunate from my point of view because the highest office of the land, the Office of the President should rather be seen as enforcing or complying with the laws of the land instead of being at the forefront of violating or breaking the laws.<\/p>\n\n\n\n<p>\u201cThat is what disturbs me but I am happy to say that never again should that happen since it is the Supreme Court that has decided. I am sure it will be upheld by this government and subsequent governments so no Auditor-General may face or suffer what I suffered, that is my happiness.\u201d<\/p>\n\n\n\n<p>The Supreme Court gave the ruling on Wednesday, May 31.<\/p>\n\n\n\n<p>President Akufo-Addp appointed an Acting Auditor-General after asking Mr Daniel Domelevo to take his accumulated annual leave of 123 working days on Wednesday, July 1, 2020.<\/p>\n\n\n\n<p>A statement released by the Presidency and signed by the Director of Communication, Eugene Arhin, on Monday, 29 June 2020, explained that the decision to direct Mr Domelevo to take his accumulated annual leave was based on Sections 20(1) and Labour Act, 2003 (Act 651), which apply to all workers including public officeholders such as the Auditor-General.<\/p>\n\n\n\n<p>Per the Act, a worker is entitled to annual leave with full pay, in a calendar year of continuous service which cannot be relinquished or forgone by the worker or the employer.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"608\" height=\"302\" src=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2023\/06\/domelovo-3-1.jpg\" alt=\"\" class=\"wp-image-11487\" srcset=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2023\/06\/domelovo-3-1.jpg 608w, https:\/\/expressnewsghana.com\/wp-content\/uploads\/2023\/06\/domelovo-3-1-600x298.jpg 600w, https:\/\/expressnewsghana.com\/wp-content\/uploads\/2023\/06\/domelovo-3-1-300x149.jpg 300w\" sizes=\"(max-width: 608px) 100vw, 608px\" \/><figcaption class=\"wp-element-caption\"><strong>Daniel Domelevo<\/strong><\/figcaption><\/figure>\n\n\n\n<p>Mr Domelevo is said to have taken only nine working days of his accumulated annual leave of 132 working days since his appointment as Auditor-General on December 30, 2016.<\/p>\n\n\n\n<p>The statement made reference to a 9 April 2009 directive by the third President of the 4th Republic, Prof John Evans Atta Mills, who asked then Auditor-General, Edward Duah Agyeman, to take his accumulated annual leave of approximately 264 working days.<\/p>\n\n\n\n<p>\u201cPresident Akufo-Addo paid attention to the precedent in directing the Auditor-General to take his accumulated annual leave of 123 working days,\u201d the statement by the Jubilee House had said.<\/p>\n\n\n\n<p>But the government was sued over this matter.<\/p>\n\n\n\n<p>The Attorney General\u2019s Office was named as a defendant.<\/p>\n\n\n\n<p>Nine Civil Society Organisations (CSOs) who sued wanted the Supreme Court to rule that the President\u2019s directive was inconsistent with or was in contravention of the letter and spirit of Article 187(7)(a) of the Constitution, 1992.<\/p>\n\n\n\n<p>The office of the Auditor-General and Johnson Akuamoah who was the acting Auditor-General were also named as defendants.<br \/>Nevertheless, Mr Domelevo said he prayed that no Auditor-General would experience his ordeal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mr Daniel Domelevo, the embatttled for former Auditor-General Daniel Domelevo has said that the Supreme Court ruling that declared his removal from office as unconstitutional [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":11487,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[82],"tags":[],"class_list":["post-11488","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-general-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
