{"id":22245,"date":"2025-09-25T07:06:27","date_gmt":"2025-09-25T07:06:27","guid":{"rendered":"https:\/\/expressnewsghana.com\/?p=22245"},"modified":"2025-09-25T07:06:27","modified_gmt":"2025-09-25T07:06:27","slug":"legal-shake-up-as-dafeamekpor-others-sue-to-end-gbas-monopoly-status","status":"publish","type":"post","link":"https:\/\/expressnewsghana.com\/?p=22245","title":{"rendered":"Legal Shake-Up as Dafeamekpor, Others Sue to End GBA\u2019s Monopoly Status"},"content":{"rendered":"<p><strong>The Supreme Court has been petitioned to determine whether the Ghana Bar Association (GBA) holds exclusive constitutional recognition as the country\u2019s official body of lawyers, or whether other associations can claim equal legitimacy<\/strong>.<\/p>\n<p>South Dayi MP Rockson Nelson Dafeamekpor, lawyer Israel Tetteh, and the Ghana Law Society have jointly filed a writ challenging what they describe as the GBA\u2019s \u201cwrongful appropriation\u201d of the constitutional identity of the Bar. They have sued the Attorney-General and the GBA itself.<\/p>\n<p>According to the plaintiffs, the GBA is not a statutory body, but a private voluntary association registered under the laws of Ghana like any other club or society. They argue that constitutional references to the \u201cGhana Bar Association\u201d do not confer monopoly status on the current body.<\/p>\n<p>\u201cThe Ghana Bar Association is not the exclusive embodiment of the Bar in Ghana,\u201d their writ states, describing the GBA\u2019s posture as misleading and contrary to the spirit of the 1992 Constitution.<\/p>\n<p>The suit further points to constitutional provisions that assign roles to the \u201cGhana Bar Association\u201d \u2014 including nominating representatives to the Judicial Council and other statutory bodies, as captured in Articles 153, 157, 201, 204, 166, 209, 259, 261 and 206. The plaintiffs maintain that these references should be interpreted as descriptive rather than exclusive.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-18896\" src=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2025\/01\/50274697.295.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2025\/01\/50274697.295.jpg 300w, https:\/\/expressnewsghana.com\/wp-content\/uploads\/2025\/01\/50274697.295-250x188.jpg 250w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>They contend that granting the GBA sole privileges undermines Articles 17 and 21 of the Constitution, which guarantee equality before the law and freedom of association.<\/p>\n<p>The reliefs sought include a declaration that rival lawyer associations have equal constitutional recognition and an order restraining the GBA from presenting itself as the only bar in Ghana.<\/p>\n<p>Dafeamekpor and his co-plaintiffs say they are pursuing the matter in both their personal capacity and the public interest \u201cto vindicate the supremacy of the Constitution and ensure that the rule of law is not undermined by the conduct of a private association.\u201d<\/p>\n<p>The Attorney-General and the GBA are expected to respond in the coming weeks.
