{"id":23067,"date":"2025-12-10T19:09:51","date_gmt":"2025-12-10T19:09:51","guid":{"rendered":"https:\/\/expressnewsghana.com\/?p=23067"},"modified":"2025-12-10T19:09:51","modified_gmt":"2025-12-10T19:09:51","slug":"minority-accuses-parliament-of-setting-toxic-precedent-with-kpandai-seat-notification","status":"publish","type":"post","link":"https:\/\/expressnewsghana.com\/?p=23067","title":{"rendered":"Minority Accuses Parliament of Setting \u2018Toxic Precedent\u2019 with Kpandai Seat Notification"},"content":{"rendered":"<p><strong>The Deputy Minority Leader, Patricia Appiagyei, has sharply criticised Parliament for what she terms a premature, unlawful, and dangerous move to notify the Electoral Commission (EC) that the Kpandai parliamentary seat is vacant.<\/strong><\/p>\n<p>According to the Asokwa MP, the Clerk\u2019s letter to the EC\u2014issued solely based on a High Court ruling that annulled the election of NPP MP Matthew Nyindam\u2014violates established constitutional processes and breaks Parliament\u2019s long-standing tradition of restraint.<\/p>\n<p>Addressing journalists on Wednesday, 10 December 2025, Hon. Appiagyei warned that Parliament risks committing \u201ca constitutional travesty and historical self-betrayal.\u201d<\/p>\n<p>\u201cWe are rushing to enforce a judgment that is legally suspended, appealed, and under certiorari review,\u201d she stated. \u201cWhat manner of Parliament are we?\u201d<\/p>\n<p>She argued that the High Court ruling cannot form the basis for declaring the seat vacant because the embattled MP has invoked critical constitutional remedies, including filing a stay of execution\u2014which suspends the judgment\u2014lodging a notice of appeal at the Court of Appeal, and applying for certiorari at the Supreme Court.<\/p>\n<p>\u201cA stayed judgment is not enforceable. An appealed judgment is not final. Yet this House is pretending otherwise,\u201d she said.<\/p>\n<p>The Deputy Minority Leader further contended that the notification effectively disenfranchises the 3,734 voters who elected Nyindam and undermines the authority of the appellate courts currently reviewing the matter.<\/p>\n<figure id=\"attachment_23058\" aria-describedby=\"caption-attachment-23058\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-23058 size-full\" src=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2025\/12\/595945716_1255277409954997_6979299446008971023_n.jpg\" alt=\"\" width=\"600\" height=\"400\" srcset=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2025\/12\/595945716_1255277409954997_6979299446008971023_n.jpg 600w, https:\/\/expressnewsghana.com\/wp-content\/uploads\/2025\/12\/595945716_1255277409954997_6979299446008971023_n-250x167.jpg 250w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><figcaption id=\"caption-attachment-23058\" class=\"wp-caption-text\"><em>From L-R, Daniel Nsala Wakpal (NDC) and Mathew Nyindam (NPP) <\/em><\/figcaption><\/figure>\n<p>Hon. Appiagyei cited several historical precedents where Parliament exercised caution until all legal processes were exhausted. She referenced the case of Samuel Nyimakan in Wulensi, where the seat was declared vacant only after the Court of Appeal delivered its final ruling. She also cited former MPs Eric Amoateng, Dan Abodakpi, and Adamu Dramani Sakande\u2014each of whom remained MPs until the legal processes against them reached finality or their circumstances legally necessitated removal.<\/p>\n<p>She clarified that in the high-profile James Gyakye Quayson case, Parliament acted only on explicit Supreme Court orders, not on a first-instance High Court decision.<\/p>\n<p>\u201cQuayson\u2019s case teaches Parliament to wait for the Supreme Court. In Kpandai, we are ignoring that lesson entirely,\u201d she said.<\/p>\n<p>Hon. Appiagyei warned that allowing a single High Court ruling to instantly unseat an MP could pave the way for political manipulation.<\/p>\n<p>\u201cWe will establish a toxic precedent where a majority can weaponize first-instance judgments to remove opponents,\u201d she cautioned. \u201cIt will render appellate courts irrelevant.\u201d<\/p>\n<p>She argued that the Clerk\u2019s notification violates Article 99(1)(e) of the Constitution by treating a non-final judgment as conclusive. She also described it as a breach of the separation of powers and a departure from Parliament\u2019s tradition of respecting judicial processes.<\/p>\n<p>Calling for an immediate withdrawal of the notification, she insisted: \u201cThis premature action violates the Constitution, disrespects the judiciary, and unjustly disenfranchises the people of Kpandai. Respect the stay. Await the appeals. Honour our history. Uphold the Constitution.\u201d<\/p>\n<p>Hon.
