{"id":5189,"date":"2022-03-12T22:59:10","date_gmt":"2022-03-12T22:59:10","guid":{"rendered":"https:\/\/expressnewsghana.com\/?p=5189"},"modified":"2022-03-12T23:19:38","modified_gmt":"2022-03-12T23:19:38","slug":"i-dont-have-enough-cash-to-go-for-review-of-supreme-court-ruling-on-deputy-speaker-voting-right-abdulai","status":"publish","type":"post","link":"https:\/\/expressnewsghana.com\/?p=5189","title":{"rendered":"I don\u2019t have enough cash to go for Review of Supreme Court ruling on Deputy Speaker voting right- Abdulai"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Private legal practit<\/strong>i<strong>oner, Justice Abdulai is telling persons asking him to go for a review of the Supreme Court ruling on the <\/strong>right of Deputy Speakers to vote in Parliament while presiding in the House, to support him financially to enable him to <strong>do that.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking on the Key Points show on TV3 with Dzifa Bampoh on Saturday, March 12, he said \u201cAll those urging me, including Speaker Bagbin to go for a review, [persons] from the NPP and the NDC, please, I need more money because it is for the national interest.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaker Bagbin had earlier urged him to go for a review of the ruling. In the view of Mr Bagbin, the ruling was not only an absurdity but a reckless incursion into the remit of Parliament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI have resisted the temptation of making a comment on the judgment of the Supreme Court on the issue of the voting rights of Deputy Speakers when presiding. But the unfortunate and myopic comment of the President has compelled me to let it out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe SC decision, is, to say the least, not only an absurdity but a reckless incursion into the remit of Parliament.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2022\/03\/312202262537-l5gsj7v331-22210d68-ccae-41fd-9e7a-a7d36dad3d10.jpg\" alt=\"\" class=\"wp-image-5190\"\/><figcaption>MR ABDULAI<\/figcaption><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe trend of unanimity is equally troubling. It doesn&#8217;t help explore and expand our legal jurisprudence. The President&#8217;s comment is myopic and unfortunate. It only goes to worsens the schism between the Executive and Parliament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe impartiality of the Speaker, Deputy Speaker, or Presiding Officer has been treasured and fought for by this country throughout our democratic development. Mr. President, the issue being discussed is not about Parliament being above the law. Everyone knows that Parliament is not above the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Executive and the Judiciary are equally not above the law. The issue being discussed is the political question doctrine. It took centuries to detail out the strands of this doctrine and the principles are settled as to when and how this closed book could be opened. Please, I encourage Plaintiff to go for a review,\u201d he said in a statement on Friday, March 11.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The apex court on Wednesday, March 9 dismissed an application to pronounce as unconstitutional, Joseph Osei Wusu&#8217;s action of counting himself for the purposes of quorum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Jones Dotse ruled that the Deputy Speaker of Parliament&#8217;s participation in voting was constitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Private legal practitioner and law lecturer, Justice Abdulai subsequent to the November 30, 2021 clash between Speaker Bagbin and his First Deputy after the latter overturned an earlier vote of the House rejecting Government&#8217;s 2022 Budget invited the Supreme Court to pronounce as unconstitutional, Deputy Speaker, Joseph Osei Owusu&#8217;s action of counting himself for the purposes of quorum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He argued in the context of articles 102 and 104 of the 1992 Constitution that the Deputy Speaker was not permitted to count himself for the purposes of quorum, since he had neither an original nor a casting vote as Speaker presiding.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"800\" height=\"483\" src=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2022\/01\/Judges.jpg\" alt=\"\" class=\"wp-image-3793\" srcset=\"https:\/\/expressnewsghana.com\/wp-content\/uploads\/2022\/01\/Judges.jpg 800w, https:\/\/expressnewsghana.com\/wp-content\/uploads\/2022\/01\/Judges-370x223.jpg 370w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">But the 7-member panel of justices ruled that the Member of Parliament for Bekwai exercised his right constitutionally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The SC struck out the standing order 109(3) which says a Deputy Speaker or any other member presiding shall not retain his original vote while presiding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It furthered that the Deputy Speaker can be counted during the quorum for decision making according to article 104(1)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Jones Dotse noted that the full ruling will be made available on Friday, March
